Terms of Use for Trade With Mario.

1. Agreement to these Terms

By accessing or using this website, joining a waitlist, purchasing a session or package, participating in a coaching call, viewing a live stream, submitting a form, or otherwise interacting with Trade With Mario, you agree to these Terms of Use and the Risk Disclaimer and Privacy Policy referenced in these Terms.

If you do not agree, do not use the website or purchase services.

2. Eligibility and account/payment accuracy

You must be at least 18 years old, or the age of legal majority where you live, to purchase mentorship services or participate in paid coaching. You agree that information you provide, including your name, email, selected service, booking details, and payment information, is accurate and current.

You may not use the website or services for fraud, spam, unauthorized access, market manipulation, unlawful financial activity, or any activity that violates applicable law or platform rules.

3. Educational services only

Trade With Mario provides educational trading mentorship and coaching. Services may include one-on-one calls, trade review, chart discussion, journaling review, execution review, risk-management discussion, live streams, educational examples, and general trading process development.

Trade With Mario does not act as your broker, investment adviser, commodity trading advisor, financial planner, account manager, portfolio manager, fiduciary, tax adviser, or legal adviser.

4. No financial, investment, tax, or legal advice

All website content, coaching discussions, live streams, examples, charts, comments, messages, and materials are provided for general educational purposes only. Nothing should be interpreted as a recommendation or instruction to buy, sell, hold, short, enter, exit, size, hedge, copy, or otherwise trade any financial product, market, asset, broker account, funded account, crypto asset, CFD, forex pair, futures contract, option, stock, index, commodity, or other instrument.

Even during one-on-one coaching, discussions are not tailored financial advice. You remain solely responsible for your trades, financial decisions, tax treatment, legal obligations, broker selection, funded-account compliance, and risk management.

5. Bookings, payment, crypto payments, and availability

Services may be offered as individual sessions, packages, premium coaching, custom reviews, or other options shown on the website. Prices, availability, package details, and features may change at any time before purchase.

Crypto payments may be accepted through a checkout provider, invoice, or wallet/payment flow selected by Trade With Mario. Crypto payments may involve network fees, exchange-rate changes, processing delays, wallet mistakes, and third-party provider terms. You are responsible for sending the correct asset, amount, network, and address. Trade With Mario is not responsible for losses caused by sending funds to the wrong address, using the wrong network, exchange delays, wallet errors, or third-party provider issues.

A service may be marked fully booked. If so, the site may offer a waitlist instead of purchase. Joining a waitlist does not guarantee access, timing, pricing, or acceptance into a coaching service.

6. Cancellations, rescheduling, refunds, and no-shows

Unless a separate written policy is provided for a specific service, all payments are for educational time, preparation, scheduling, and access to the purchased service. Requests to reschedule should be made as early as possible. Trade With Mario may allow one reschedule when reasonable notice is given, but rescheduling is subject to availability.

Missed sessions, late arrivals, failure to provide required materials, or failure to attend at the scheduled time may result in forfeiture of that session. Refunds are not guaranteed and may be denied after a session has been scheduled, accessed, attended, partially delivered, or where preparation work has begun, except where required by applicable law.

If Trade With Mario must cancel or reschedule a session, you will be offered a reasonable replacement time or other reasonable resolution.

7. Student responsibilities and prohibited conduct

You agree to use the website and services responsibly and lawfully. You may not harass, threaten, abuse, impersonate, spam, scrape, reverse engineer, interfere with website security, misuse payment systems, submit false information, record sessions without permission, share private access links, or use the services to promote unlawful activity.

You are responsible for protecting your trading accounts, platform logins, wallet credentials, seed phrases, private keys, exchange accounts, broker accounts, and funded-account credentials. Trade With Mario will never ask for your seed phrase, private key, trading account password, or full account login credentials.

8. Intellectual property, recordings, and confidentiality

The website, branding, text, layouts, coaching materials, frameworks, notes, call structures, educational examples, and other content provided by Trade With Mario are owned by Trade With Mario or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You receive a limited, personal, non-exclusive, non-transferable, revocable license to use materials provided to you for your own education only. You may not copy, publish, sell, resell, distribute, upload, share, reproduce, record, train an AI system on, or commercially exploit sessions, materials, frameworks, or private communications without written permission.

Live or private sessions may not be recorded unless all parties agree in advance. Materials, notes, examples, and private session discussions should be treated as confidential unless Trade With Mario gives written permission to share them.

9. Third-party platforms and links

The website or services may use or link to third-party platforms, such as payment processors, crypto checkout providers, email tools, video-call tools, streaming platforms, analytics tools, brokers, charting platforms, or social media sites. Third-party services are governed by their own terms and privacy policies. Trade With Mario is not responsible for third-party outages, errors, policies, fees, losses, or security incidents.

10. Testimonials, examples, and performance references

Any testimonials, examples, trade illustrations, case studies, simulated results, backtests, chart reviews, or student comments are for educational and informational purposes only. They do not represent typical results and do not guarantee that you will achieve the same or similar outcome.

Trading outcomes depend on many factors, including market conditions, experience, risk management, discipline, broker execution, fees, spreads, leverage, funded-account rules, and individual decision-making.

11. Disclaimers

The website and services are provided “as is” and “as available.” Trade With Mario does not guarantee that the website, forms, checkout links, live streams, video calls, or content will be uninterrupted, error-free, secure, profitable, or suitable for your specific needs.

Trade With Mario does not guarantee profits, funded-account approvals, funded-account payouts, trading consistency, risk-free trading, improved performance, or any financial result.

12. Limitation of liability

To the fullest extent permitted by law, Trade With Mario and its owners, contractors, service providers, and affiliates will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, trading losses, account losses, funded-account losses, crypto transaction losses, business interruption, data loss, or reliance on educational materials.

To the fullest extent permitted by law, any total liability arising from the website or services will not exceed the amount you paid to Trade With Mario for the specific service giving rise to the claim.

13. Indemnification

You agree to defend, indemnify, and hold harmless Trade With Mario and its owners, contractors, service providers, and affiliates from claims, losses, liabilities, damages, costs, and expenses arising from your use of the website or services, your trading activity, your violation of these Terms, your violation of law, your misuse of materials, or your infringement of another person’s rights.

14. Termination or refusal of service

Trade With Mario may refuse, suspend, or terminate access to services, waitlists, bookings, or communications if it believes you violated these Terms, acted abusively, misused materials, engaged in fraud, created security risk, or used the services in a way that is harmful or unlawful.

15. Governing law and disputes

Unless otherwise required by applicable law, these Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Venue for disputes will be in the state or federal courts located in Orange County, California, unless a different venue is required by law.

16. Changes to these Terms

Trade With Mario may update these Terms from time to time. The “Last Updated” date will show when changes were made. Continued use of the website or services after changes means you accept the updated Terms.
